Where this Privacy Notice refers to “Batutta”, “we”, “us” or “our”, it is referring to Serendipity Tailormade Limited. All copyright and other intellectual property rights in any material, including html code, text, photographs or other images displayed on our website, are either owned by us or have been licensed by the owner for our use. If you wish to use any of the information or material displayed on our website, you must first obtain our written permission, or that of the owner of the rights to the material, as the case may be. We do not accept any liability to you or any third party for any error or omission on this website or in information sent through other means. We may change, update or delete any information on this website without prior notice. We do not warrant that this website will be uninterrupted, error free or that any information or other material accessible from this website is free of viruses or other harmful components.

We do not make any representation about the suitability of information, products and services on this website and what is communicated to you directly for any purpose. The website is provided on an “as is” and on an “on request” basis. You assume all responsibility and risk for use of this website and our service. We will not be responsible for any errors, omissions or misleading information and we disclaim, to the maximum extent permitted by law, all implied warranties in connection with such information.

We endeavour to ensure the accuracy of all the information and prices in our advertising material. However, occasionally changes and errors do arise and we reserve the right to correct them in such circumstances. Upon receipt of a priced itinerary, you must check the current price with the provider directly and all other information relating to the arrangements that you wish to book before your booking is confirmed. Furthermore, we will not be liable for booking errors which are attributable to you.

Prices

Prices communicated with you are in British Pounds (£) unless explicitly mentioned otherwise with rates of exchange calculated on a daily basis. Prices may therefore differ on a daily basis to reflect any movement in exchange rate levels. Batutta have no control or influence on the prices charged by third parties and take no responsibility for fluctuations in prices offered

Changes to terms and conditions

We may amend these terms and conditions at any time without prior notice. If we do amend these terms and conditions, the amended terms will be effective when posted on this website.

Booking Conditions

We do not handle any of the booking process and this is to be completed with external travel providers directly. Whilst we endeavour to communicate any necessary important information with you, any bookings that you make are subject to the terms and conditions of the provider that the booking is made with. Whilst we will advise you of various options that are available and the respective booking process for each one, we do not take any responsibility for any aspect of a booking that you make as a result.

Passport, Visa and Immigration Requirements and Health Formalities

It is your responsibility to check and fulfil the passport, visa, health and immigration requirements applicable to your itinerary. We can only provide general information about this. You must check requirements for your own specific circumstances with the relevant Embassies and/or Consulates and your own doctor as applicable. Requirements do change and you must check the up to date position in good time before departure.

Most countries now require passports to be valid for at least 6 months after your return date. If your passport is in its final year, you should check with the Embassy of the country you are visiting. For further information contact the Passport Office on 0870 5210410 or visit www.passport.gov.uk

Up to date travel advice can be obtained from the Foreign and Commonwealth Office, visit www.fco.gov.uk

Non British passport holders, including other EU nationals, should obtain up to date advice on passport and visa requirements from the Embassy, High Commission or Consulate of your destination or country(ies) through which you are travelling.

We do not accept any responsibility if you cannot travel, or incur any other loss because you have not complied with any passport, visa, immigration requirements or health formalities.

Flights

In accordance with EU Directive (EC) No 2111/2005 Article 9, we are required to bring to your attention the existence of a “Community list” which contains details of air carriers that are subject to an operating ban with the EU Community. Star Ratings

Every effort has been made to ensure that the hotels and other accommodation we advise you are correctly represented and will fulfil your expectations for quality and service. It is important to note that, where used; the star classification system is our own and does not conform to any internationally recognised system. The rating, in our opinion, reflects a true representation of the merits of each property. Inevitably, standards will differ slightly between the many destinations which we feature.

2* Economical and comfortable accommodation offering a simple standard of room and limited facilities.

3* Comfortable accommodation with standard rooms, amenities and public areas. Most three-star properties offer a restaurant on-site and some have a swimming pool.

4* Good superior accommodation offering a selection of services. Most four-star hotels feature a choice of restaurants and in addition, many also have a health club and swimming pool.

5* Five-star hotels offer the highest standards of service and facilities and are acknowledged as the leading properties in the area.

5 * The adjacent symbol gives recognition to hotels of exceptional quality.

* Indicates a hotel falling between two categories.

Services Offered

The Service is a custom travel itinerary planning service. Batutta creates a digitally delivered itinerary based on the request submitted by the user. Batutta is not an operator of tours, activities, nor is it a provider of tours or activities, and Batutta does not own, sell, resell, furnish, provide, manage and/or control any transportation or tour services. Our responsibilities are limited to providing a day-by-day travel itinerary for the user’s request.

You understand and agree that Batutta is not responsible for any damages and disclaims all liability that may result in following our itinerary recommendations. The partaking of any experiences recommended by us are at the traveller’s own risk.

Batutta assumes no responsibility for the Traveller’s compliance with any applicable laws, rules and regulations. We recommend that all users and associated travellers who use our planning service obtain appropriate insurance for their trips. Please review any insurance policy that you may have for your travel carefully, and in particular please make sure that you are familiar with and understand any exclusions to, and any deductibles that may apply for, such insurance policy.

While we makes every effort to ensure information provided is accurate and up-to-date, the traveller is ultimately responsible for checking their itinerary and making sure that suggested routes, addresses, opening times, and other information is accurate.

Recommendations: Please be advised that recommendations given by Batutta are based on the opinions of selected individuals who partner with us and share their advice. We relay their knowledge of the establishments and makes no guarantee about the suitability or availability of the recommendations.

Batutta also provides a platform to share travel content through our blog and other channels, as well as itinerary planning tools. Batutta cannot and does not control the content shared on the site. Batutta reserves the right, at any time and without prior notice, to remove or disable access to any profile for any reason, including profiles that Batutta, in its sole discretion, considers to be objectionable for any reason, in violation of these Terms or otherwise harmful to the services.

Endorsement

Tryp Hacker does not endorse any content created and shared by users of the site. In addition, although these Terms require users to provide accurate information, we do not attempt to confirm, and do not confirm, any user’s purported identity. You are responsible for determining the identity and suitability of others who you contact via the Site, Application and Services. Tryp Hacker will not be responsible for any damage or harm resulting from your interactions with other users. By using the Site, Application or Services, you agree that any legal remedy or liability that you seek to obtain for actions or omissions of other users or other third parties will be limited to a claim against the particular users or other third parties who caused you harm and you agree not to attempt to impose liability on, or seek any legal remedy from Tryp Hacker with respect to such actions or omissions. Accordingly, we encourage you to communicate directly with other users on the Site and Services regarding any trip plans made by you.

Restrictions

We are under no obligation to enforce the Terms on your behalf against another user. While we encourage you to let us know if you believe another user has violated the Terms, we reserve the right to investigate and take appropriate action at our sole discretion.

A. You agree not to, and will not assist, encourage, or enable others to use the Site to: Violate our Content Guidelines, for example, by writing a fake or defamatory recommendations, being compensated to make or not make a recommendation; Violate any third party's rights, including any breach of confidence, copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right; Threaten, stalk, harm, or harass others, or promote bigotry or discrimination; Promote a business or other commercial venture or event, or otherwise use the Site for commercial purposes, except as expressly permitted by us; Send bulk emails, surveys, or other mass messaging, whether commercial in nature or not; engage in keyword spamming, or otherwise attempt to manipulate the Site's search results or any third party website; Solicit personal information from minors, or submit or transmit pornography; or Violate any applicable law.

B. You also agree not to, and will not assist, encourage, or enable others to: Violate the Terms; Modify, adapt, appropriate, reproduce, distribute, translate, create derivative works or adaptations of, publicly display, sell, trade, or in any way exploit the Site or Site Content, except as expressly authorised by us; Use any robot, spider, site search/retrieval application, or other automated device, process or means to access, retrieve, scrape, or index any portion of the Site or any Site Content; Reverse engineer any portion of the Site; Remove or modify any copyright, trademark or other proprietary rights notice that appears on any portion of the Site or on any materials printed or copied from the Site; Record, process, or mine information about other users; Access, retrieve or index any portion of the Site for purposes of constructing or populating a searchable database; Reformat or frame any portion of the Site; Take any action that imposes, or may impose, in our sole discretion, an unreasonable or disproportionately large load on Tryp Hacker’s technology infrastructure or otherwise make excessive traffic demands of the Site; Attempt to gain unauthorised access to the Site, user accounts, computer systems or networks connected to the Site through hacking, password mining or any other means; Use the Site or any Site Content to transmit any computer viruses, worms, defects, Trojan horses or other items of a destructive nature (collectively, "Viruses"); Use any device, software or routine that interferes with the proper working of the Site, or otherwise attempt to interfere with the proper working of the Site; Use the Site to violate the security of any computer network, crack passwords or security encryption codes; disrupt or interfere with the security of, or otherwise cause harm to, the Site or Site Content; or Remove, circumvent, disable, damage or otherwise interfere with any security-related features of the Site, features that prevent or restrict the use or copying of Site Content, or features that enforce limitations on the use of the Site. The restrictions above only apply to the extent permissible under applicable law. Nevertheless, you agree not to act contrary to them (even if permissible under applicable law) without providing 30 days' prior written notice to us here, together with any information that we may reasonably require to give us an opportunity to provide alternative remedies or otherwise accommodate you at our sole discretion.

Refund and Cancellation Policy of Itinerary Fee

All members are eligible for an initial consultation after the payment of the itinerary consulting fee which is fully refundable up to 24 hours after the end of your initial consultation.

Refunds are not possible after this stated period.

Content

Responsibility for Your Content: You alone are responsible for Your Content, and once published, it cannot always be withdrawn. You assume all risks associated with Your Content, including anyone's reliance on its quality, accuracy, or reliability, or any disclosure by you of information in Your Content that makes you personally identifiable. You represent that you own, or have the necessary permissions to use and authorise the use of Your Content as described herein. You may not imply that Your Content is in any way sponsored or endorsed by Tryp Hacker. You may expose yourself to liability if, for example, Your Content contains material that is false, intentionally misleading, or defamatory; violates any third-party right, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right; contains material that is unlawful, including illegal hate speech or pornography; exploits or otherwise harms minors; or violates or advocates the violation of any law or regulation.

Our Right to Use Your Content: We may use Your Content in a number of different ways, including publicly displaying it, reformatting it, incorporating it into advertisements and other works, creating derivative works from it, promoting it, distributing it, and allowing others to do the same in connection with their own websites and media platforms ("Other Media"). As such, you hereby irrevocably grant us world-wide, perpetual, non-exclusive, royalty-free, assignable, sub licensable, transferable rights to use Your Content for any purpose. Please note that you also irrevocably grant the users of the Site and any Other Media the right to access Your Content in connection with their use of the Site and any Other Media. Finally, you irrevocably waive, and cause to be waived, against Batutta and its users any claims and assertions of moral rights or attribution with respect to Your Content. By "use" we mean use, copy, publicly perform and display, reproduce, distribute, modify, translate, remove, analyse, commercialise, and prepare derivative works of Your Content.

Ownership: We own the Batutta Content, including but not limited to visual interfaces, interactive features, graphics, design, compilation, including, but not limited to, our compilation of User Content and other Site Content, computer code, products, software, aggregate user review ratings, and all other elements and components of the Site excluding Your Content, User Content and Third Party Content. We also own the copyrights, trademarks, service marks, trade names, and other intellectual and proprietary rights throughout the world ("IP Rights") associated with the Batutta Content and the Site, which are protected by copyright, trade dress, patent, trademark laws and all other applicable intellectual and proprietary rights and laws. As such, you may not modify, reproduce, distribute, create derivative works or adaptations of, publicly display or in any way exploit any of theBatutta Content in whole or in part except as expressly authorised by us. Except as expressly and unambiguously provided herein, we do not grant you any express or implied rights, and all rights in and to the Site and the Batutta Content are retained by us. Advertising Batutta and its licensees may publicly display advertisements and other information adjacent to or included with Your Content. You are not entitled to any compensation for such advertisements. The manner, mode and extent of such advertising are subject to change without specific notice to you. User Content (including any that may have been created by users employed or contracted by Batutta) does not necessarily reflect the opinion of Batutta. We reserve the right to remove, screen, edit, or reinstate User Content from time to time at our sole discretion for any reason or no reason, and without notice to you. For example, we may remove a review if we believe it violates our Content Guidelines. We have no obligation to retain or provide you with copies of Your Content, nor do we guarantee any confidentiality with respect to Your Content.

Feedback

By sending us any ideas, suggestions, documents or proposals ("Feedback"), you agree that (i) your Feedback does not contain the confidential or proprietary information of third parties, (ii) we are under no obligation of confidentiality, express or implied, with respect to the Feedback, (iii) we may have something similar to the Feedback already under consideration or in development, and (iv) you grant us an irrevocable, non-exclusive, royalty-free, perpetual, worldwide license to use, modify, prepare derivative works, publish, distribute and sublicense the Feedback, and you irrevocably waive, and cause to be waived, against Batutta and its users any claims and assertions of any moral rights contained in such Feedback.

Third Parties

The Site may include links to other websites or applications (each, a "Third Party Site"). We do not control or endorse any Third Party Site. You agree that we are not responsible for the availability or contents of such Third Party Sites. Your use of Third Party Sites is at your own risk. Some of the services made available through the Site may be subject to additional third party or open source licensing terms and disclosures.

Indemnity and Liability

You agree to indemnify, defend, and hold Batutta, its parents, subsidiaries, affiliates, any related companies, suppliers, licensors and partners, and the officers, directors, employees, agents and representatives of each of them (collectively, the "Tryp Hacker") harmless, including costs, liabilities and legal fees, from any claim or demand made by any third party arising out of or relating to (i) your access to or use of the Site, (ii) your violation of the Terms, (iii) any products or services purchased or obtained by you in connection with the Site, or (iv) the infringement by you, or any third party using your account, of any intellectual property or other right of any person or entity. Batutta reserves the right, at your expense, to assume the exclusive defence and control of any matter for which you are required to indemnify us and you agree to cooperate with our defence of these claims. You agree not to settle any such matter without the prior written consent of Batutta. Batutta will use reasonable efforts to notify you of any such claim, action or proceeding upon becoming aware of it.

The site is made available to you on an "as is", "with all faults" and "as available" basis, with the express understanding that the Batutta entities may not monitor, control, or vet user content. as such, your use of the site is at your own discretion and risk. The Batutta entities make no claims or promises about the quality, accuracy, or reliability of the site, its safety or security, or the site content. Accordingly, the Batutta entities are not liable to you for any loss or damage that might arise, for example, from the site's inoperability, unavailability or security vulnerabilities or from your reliance on the quality, accuracy, or reliability of the business recommendations, ratings, reviews (including their content, order, and display), or metrics found on, used on, or made available through the site.

Batutta entities make no claims or promises with respect to any third party, such as the businesses or curators listed on the site or the site's users. Accordingly, the Batutta entities are not liable to you for any loss or damage that might arise from their actions or omissions, including, for example, if another user or business misuses your content, identity or personal information, or if you have a negative experience with one of the businesses or curators listed or featured on the site. Your purchase and use of products or services offered by third parties through the site is at your own discretion and risk.

Batutta entities expressly disclaim all warranties, whether express or implied, including warranties as to the products or services offered by businesses listed on the site, and implied warranties of merchantability, fitness for a particular purpose, and non-infringement. No oral or written information or advice provided to you by a representative of one of the Tryp Hacker entities shall create a representation or warranty. Your sole and exclusive right and remedy in case of dissatisfaction with the site, related services, or any other grievance shall be your termination and discontinuation of access to, or use of the site.

However and to the extent permitted by law, neither we nor any of our officers, directors, employees, representatives, subsidiaries, affiliated companies, distributors, affiliate (distribution) partners, licensees, agents or others involved in creating, sponsoring, promoting, or otherwise making available the site and its contents shall be liable for (i) any punitive, special, indirect or consequential loss or damages, any loss of production, loss of profit, loss of revenue, loss of contract, loss of or damage to goodwill or reputation, loss of claim, (ii) any inaccuracy relating to the (descriptive) information (including rates, availability and ratings) of the Trip Provider as made available on our Platform, (iii) the services rendered or the products offered by the Trip Provider or other business partners, (iv) any (direct, indirect, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, pursuant to, arising out of or in connection with the use, inability to use or delay of our Platform, or (v) any (personal) injury, death, property damage, or other (direct, indirect, special, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, whether due to (legal) acts, errors, breaches, (gross) negligence, willful misconduct, omissions, non-performance, misrepresentations, tort or strict liability by or (wholly or partly) attributable to the Trip Provider or any of our other business partners (including any of their employees, directors, officers, agents, representatives, subcontractors or affiliated companies) whose products or service are (directly or indirectly) made available, offered or promoted on or through the Platform, including any (partial) cancellation, overbooking, strike, force majeure or any other event beyond our control.
